How We Review the DUI Investigation
Our review starts with your account of the events leading from the traffic stop to the arrest and chemical testing. This context helps us assess the records and identify disputed facts that may not be clear from the officer’s written account.
We obtain and examine available police reports, video footage, and testing records. We then look for legal and factual issues, including what the officer observed, how the encounter unfolded, and whether the documented evidence supports the charge.
Attorney Fanduzz has completed DUI Detection & Standardized Field Sobriety Testing certification, which involves the same training police officers receive. Standardized field sobriety testing refers to structured roadside exercises officers use to observe possible signs of impairment. This training informs our review of how officers explained and administered the tests and documented the results.
Clear Fees & 24/7 Access from Outside Tennessee
We’re available 24/7, and your initial consultation is free. We can listen to what happened, discuss the Tennessee charge, and address the practical concerns of coordinating a defense while you live outside the state.
DUI matters are often handled on a flat-fee basis. The fee varies based on the case’s complexity, the court involved, and the likelihood of trial. Before engagement, we explain the fee structure in writing so you can review the terms before deciding how to proceed.

Tennessee DUI Convictions & Your Home-State License
An arrest and a conviction aren’t the same. An arrest begins the Tennessee case, while a qualifying conviction can trigger reporting and licensing consequences under the Interstate Driver License Compact. Participating states use this framework to exchange information about specified driving convictions.
Tennessee enacted the Interstate Driver License Compact effective July 1, 2020, under Tennessee Code Annotated § 55-50-901 and the sections that follow. Under the agreement, Tennessee must report a qualifying DUI conviction to the licensee’s home state when that state also participates.
The home state must give the underlying conduct the same effect for suspension, revocation, or limitation purposes as if it had occurred there. The exact result depends on that state’s laws and the driver’s record, so a Tennessee conviction doesn’t produce one universal home-state outcome.
A participating state also may not issue a new driver’s license while a qualifying suspension or revocation imposed by another party state remains in effect. This rule can matter when a driver applies for a new license or attempts to change licensing states while an unresolved action remains on the record.
Test Refusal & Restricted Licenses
Tennessee’s implied-consent law deems a person who drives in the state to have consented to a breath test, blood test, or both when an officer has probable cause to believe the person was driving while impaired. That law is separate from the criminal DUI charge and creates its own license-related issues.
Refusing a requested test results in license revocation rather than criminal punishment under that law. For a first refusal, the revocation period is generally one year when the person has no qualifying prior conviction, though the exact period can vary by the type of test refused and when the refusal occurred. Whether other consequences apply depends on the facts, the person’s record, and the law governing the home-state license.
A person whose license is suspended for a refusal may apply to the court for a restricted license for travel to and from work or a court-ordered alcohol safety program. An application doesn’t guarantee approval. Eligibility and permitted travel depend on the governing requirements and the court’s decision.
Knoxville DUI Court Process & First-Offense Penalties
In Knoxville, DUI cases are handled in Second Sessions Court, and most people arrested locally are initially booked at the detention facility. If a case proceeds by indictment, arraignment occurs in one of the area’s three Criminal Court divisions. The path a particular case follows depends on its procedural history.
A first DUI conviction in Tennessee is a Class A misdemeanor with the following statutory consequences:
A mandatory minimum of 48 hours in jail
A maximum sentence of 11 months and 29 days
A minimum fine of $350
Mandatory attendance at DUI school
A one-year license revocation
These are Tennessee criminal and licensing consequences. Separate action involving a home-state driver’s license depends on the Compact and that state’s laws. Required court appearances also depend on the charge, the court, and the orders entered in the individual case, so an out-of-state defendant shouldn’t assume an appearance is excused.
“Mr. Fanduzz is committed to nothing but the BEST outcome for his clients.”
Nearly two years ago, I was charged with DUI and Speeding. Due to my occupation, a conviction could be detrimental to my career. I contacted Mr. Fanduzz and he was able to have my case placed on Judicial Diversion, which required me to serve only one year supervised probation (reduced from two years) and court cost. I retained my drivers license and did not have to purchase expensive car insurance.
Unfortunately, while on probation, I was charged with two counts of assault and aggravated assault. Along with these new charges, I also faced violation of my probation and the original DUI. All charges were considered Felonies at this point. There was no hesitation in hiring him to represent me again. Mr. Fanduzz not only kept me well informed, he also skillfully and agressively argued on my behalf. He arranged for my probation and judicial diversion to be reinstated and the felony assault charges to be dismissed in exchange for a plea to a misdemeanor offence.
Needless to say, I highly recommend Mr. Fanduzz because of his attention to detail and commitment to have the BEST possible outcome for his clients.
